Doc. No. 2009.004

Religious Hate Crime

Andrew Anthony (‘How one book ignited a culture war’, last week) says we were nearly saddled with a law that meant one could be imprisoned for seven years for using insulting language about religion. However, the Racial and Religious Hatred Act 2006 actually does have that effect where the words are ‘threatening’ and there is an intent to stir up hatred against a group defined by religious belief (or lack of it).

[Our current law gives inadequate force to the combined effect of articles 9 (religious freedom) and 10 (freedom of speech) of the European Convention on Human Rights.]
